2. Acceptance
These terms govern the use of SmoothSeen and the purchase of its plans. You accept them when you sign up, whether with email and password or with Google, and we record the date and the version you accepted. If you do not agree, do not use the service.
3. Description of the service
SmoothSeen is an online tool that audits websites and measures their visibility in search engines and AI assistants. Depending on the plan, it lets you:
- Analyse web pages and get a report with their issues and an action plan.
- Measure the visibility of a brand or business in AI assistants and, for local businesses, their public presence and reputation.
- Compare yourself with competitors, monitor websites periodically and receive email alerts.
- Download reports as PDF, share them by link and, on the Agency plan, present them under the agency’s own brand.
Results are obtained from the website analysed and from third-party sources and services (Google, AI assistants and others). They may vary from one analysis to another and depend on those sources responding: they are an aid to decision-making, not a guarantee of rankings.
4. Sign-up and account
- To sign up you must be over 18 and provide true and up-to-date information.
- You are responsible for keeping your credentials safe and for what is done with your account. Do not share it with others.
- Tell us as soon as you learn of any unauthorised use.
- You can delete your account at any time from your profile.
5. Acceptable use
You undertake to use SmoothSeen lawfully and, in particular, not to:
- Analyse websites for unlawful purposes or use the service to attack, overload or access other people’s systems without permission.
- Get around the limits of your plan, use the service through channels other than the app or resell access to it.
- Enter unnecessary personal data in project names, searches or the questions you track.
- Copy, decompile or try to obtain the source code of the service.
If you breach these terms, we may suspend or close your account, giving you notice first unless the seriousness of the breach prevents it.
6. Plans, prices and payments
- There is a free plan and paid plans (Professional and Agency), billed monthly or yearly. What each plan includes, its limits (analyses per month, projects, saved analyses and questions in AI assistants) and its price are those published on the pricing page at the time of purchase. The Enterprise plan is agreed case by case.
- Prices are shown excluding VAT and, as a guide for consumers, also including Spanish VAT. VAT is worked out by Stripe at checkout, depending on your country and on whether you buy as a business or as an individual: if you are a consumer in another EU country, your country’s rate applies; if you buy as a business with a VAT number from another EU country, none is added. Before paying you see the exact amount including taxes.
- Purchases of paid plans are processed by Stripe as reseller and merchant of record, through its subsidiary Sold through Link, LLC (Stripe’s Managed Payments service, shown at checkout as “Sold through Link”). Stripe charges you, calculates, files and pays the taxes, and sends you the receipts and invoices, which are issued by Stripe, not by SmoothSeen. When you pay you also accept its Sold through Link terms (link.com/terms). Your card details are collected by Stripe and never reach SmoothSeen. The subscription is charged in advance and renews automatically at the end of each period (month or year) until you cancel it; on your statement it shows as “LINK.COM*” followed by the name of the service.
- You can change plan or cancel at any time from your profile, in the Stripe payment portal, or from your Link account (link.com) if you created one when paying. When the subscription ends, the account returns to the free plan: nothing saved is deleted, but the free plan limits apply and monitoring is paused.
- Periods already paid are not refunded, except as provided in section 7 or where the law requires it. As the seller, Stripe also handles payment issues and refund requests through Link support (support.link.com), and may refund a purchase under its own policy; any refund goes back to the same means of payment.
- Free trial: the Agency plan can be tried for 14 days without a card, once per person and per email. When it ends, the account returns to the free plan without any charge; nothing is deleted, monitoring is paused and we let you know.
- We may change prices or what each plan includes. If the change affects you, we will give you at least 30 days’ notice and it will apply from the next renewal; if you do not agree, you can cancel before then.
7. Consumers: right of withdrawal
SmoothSeen is purchased by professionals, businesses and consumers alike. If you are a consumer (you buy for purposes outside your trade, business, craft or profession), in addition to the other rights the law gives you:
- Period: you may withdraw from the contract for a paid plan within 14 calendar days from the day you purchase it, without giving any reason and without penalty (arts. 102 et seq. of the Spanish consolidated General Law for the Protection of Consumers and Users, TRLGDCU).
- Immediate start: a paid plan starts working as soon as you pay. That is why, before you go to payment, we ask you to tick a box by which you expressly request that the service start straight away, within the withdrawal period, and acknowledge that, once it has started, you lose your right of withdrawal (art. 103(m) TRLGDCU, which transposes art. 16(m) of Directive 2011/83/EU). You cannot purchase without ticking it. We keep the date, the plan and the version of these terms you accepted, and we confirm it to you by email once the payment is confirmed.
- If, despite the above, the law grants you the right of withdrawal, what you paid will be refunded within 14 calendar days of your notice at the latest, using the same means of payment and at no cost to you, less the amount proportionate to the time the plan was active until your notice (arts. 107 and 108(3) TRLGDCU). The refund is made by Stripe, which took the payment as the seller; we request it on your behalf.
- How to withdraw: send us a clear statement of your decision to the email address in section 13, preferably from your account email, or by post to the owner’s address (section 1). You may use the model form in the annex, but you do not have to. It is enough to send your notice before the period ends. You can also ask Link support directly (support.link.com), which applies the withdrawal periods required by law to purchases sold through Link.
- Cancelling is not withdrawing: cancelling the subscription from your profile stops renewals, and the account returns to the free plan at the end of the period already paid, without a refund for that period (section 6).
- The 14-day free trial is not a paid contract: nothing is charged and there is nothing to withdraw from. The withdrawal period starts when you purchase a paid plan.
8. Data of agencies’ clients (data processing agreement)
When you use SmoothSeen to analyse your clients’ websites or businesses, you are the controller of the personal data about those clients that you enter, and SmoothSeen processes it on your behalf, as a processor (art. 28 GDPR). This clause is the data processing agreement between us:
- Subject matter and duration: providing the service you have purchased, for as long as you have the account.
- Data and data subjects: the identification and contact data of your clients that you enter (project name, domain, brand, searches and questions) and the public data that appears on their websites and business listings, such as the public name of a review author.
- Instructions: we will only process that data to provide the service to you and according to what you do in the app, unless a law requires otherwise; in that case we will inform you beforehand, if the law allows it.
- Confidentiality and security: anyone who accesses the data is bound by confidentiality, and we apply the security measures described in the privacy policy.
- Sub-processors: you authorise us to use the providers listed in the privacy policy. We will notify you in advance of any change to that list so that you can object.
- Assistance: we will help you respond to data subjects’ requests and meet your obligations on security, breach notification and impact assessments, and we will notify you without undue delay of any breach affecting that data.
- End of processing: when the account is deleted, the data is erased, except in backups until they expire. Before that, you can download it from your profile.
- Compliance: we will give you the information needed to demonstrate that we comply with this agreement and allow the reasonable audits you request.
For your part, you must have a legal basis for processing that data and have informed your clients that you use SmoothSeen.
9. Liability
SmoothSeen provides technical analyses and recommendations, but does not guarantee any particular ranking, traffic or results, which depend on search engines, AI assistants and many factors beyond our control. The decisions you make with the reports are yours. We use reasonable means to keep the service running without interruption, but it may stop for maintenance or because of third-party failures. Except in cases of wilful misconduct or gross negligence, our liability is limited to what you have paid in the previous twelve months.
10. Intellectual property
The software, design, brand and content of SmoothSeen belong to its owner. We grant you a limited, non-exclusive and non-transferable licence to use the service while you have the account and in accordance with these terms. You may use the reports you generate and deliver them to your clients.
11. Changes to these terms
We may change these terms. If the change is significant, we will notify you by email at least 30 days in advance. If you do not agree, you can cancel your subscription and delete your account before it applies.
12. Applicable law and jurisdiction
These terms are governed by Spanish law. For any dispute, the parties submit to the courts of the owner’s domicile, unless you are a consumer, in which case the courts of your domicile will have jurisdiction.
